CrayonHub Terms of Use

Effective Date: September 20, 2026

These Terms of Use (“Terms”) govern access to and use of CrayonHub, a childcare management platform operated by Crayon Campus, Inc. and its affiliated childcare entities (“CrayonHub,” “Crayon Campus,” “we,” “us,” or “our”).

By creating an account, accessing CrayonHub, or using any CrayonHub service, you agree to these Terms.

If you do not agree to these Terms, you should not use CrayonHub.

1. CrayonHub Services

CrayonHub provides technology used to support childcare and related administrative operations.

Features may include:

• Enrollment
• Attendance
• Child check-in and check-out
• Classroom management
• Parent and guardian information
• Authorized pickup management
• Transportation
• Staff operations
• Scheduling
• Communications
• Billing
• Payment processing
• Documents and forms
• Reporting
• Other childcare-management functions

Features may be added, changed, suspended, or removed from time to time.

2. Eligibility and Authorized Use

CrayonHub accounts are intended for authorized users such as:

• Parents and legal guardians
• Authorized caregivers
• Crayon Campus employees
• Directors and administrators
• Authorized transportation personnel
• Other individuals specifically authorized to access the platform

You may only access information and functions that you are authorized to use.

You may not attempt to access another child’s, family’s, employee’s, classroom’s, center’s, or user’s information without authorization.

3. Account Information

You agree to provide accurate and current information when using CrayonHub.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Activities performed through your account
• Maintaining accurate contact information
• Preventing unauthorized access to your account
• Promptly informing us if your account may have been compromised

You may not share an individual user account with another person unless CrayonHub specifically permits shared access for that account type.

We may require additional authentication or verification when necessary to protect accounts or sensitive information.

4. Parents, Guardians, and Child Information

Parents and guardians are responsible for providing accurate and current information concerning their child, including information relevant to the child’s:

• Identity
• Contact information
• Emergency contacts
• Authorized pickup persons
• Health and safety needs
• Allergies
• Transportation
• Schedule
• Enrollment
• Billing

CrayonHub is an administrative tool and does not replace direct communication with childcare personnel when an urgent health, safety, custody, or emergency issue exists.

Users should contact their childcare center directly when immediate attention is required.

5. Attendance and Check-In/Check-Out

Where CrayonHub provides attendance or check-in/check-out functionality, users agree to use those features accurately.

Electronic records may be used by Crayon Campus as part of its attendance, staffing, billing, licensing, transportation, safety, or operational records.

Users must not knowingly:

• Check in or check out another person without authorization
• Falsify attendance records
• Circumvent required pickup procedures
• Misrepresent the identity of a person collecting a child
• Modify records without authorization

Crayon Campus may correct attendance records when necessary to address an error or maintain accurate records.

6. Payments

6.1 Payment Services

CrayonHub may allow users to make electronic payments for childcare-related charges, including:

• Tuition
• Enrollment or registration charges
• Transportation
• Deposits
• Late charges
• Activity charges
• Outstanding account balances
• Other authorized fees or services

Payment processing may be provided through Stripe and its banking, card-network, or financial partners.

Stripe is a third-party payment services provider. Use of Stripe’s services may also be subject to Stripe’s applicable terms and privacy practices.

6.2 Authorization to Charge

By submitting a payment through CrayonHub, you represent that:

1. You are authorized to use the selected payment method;
2. The information you provide is accurate; and
3. You authorize the applicable amount displayed at the time of the transaction to be charged or debited from that payment method.

For bank or ACH payments, you also authorize the applicable debit from the bank account you provide, subject to any authorization presented when you initiate or enroll in the payment.

6.3 Recurring Payments and Autopay

If CrayonHub offers automatic or recurring payments, you will only be enrolled when you affirmatively authorize that payment arrangement.

By enrolling in recurring payments, you authorize charges or debits according to the payment schedule and terms disclosed when you enroll.

You may cancel or modify recurring payment authorization through the available account controls or by contacting Crayon Campus, subject to any payment that has already begun processing.

Cancelling autopay does not cancel amounts you otherwise owe under your childcare or enrollment agreement.

6.4 Payment Information

Payment card and bank-account credentials may be collected and processed directly by Stripe.

CrayonHub may retain transaction information such as the payment amount, date, payment status, payment method type, last four digits of a card, and processor transaction identifiers.

CrayonHub does not intend to store complete card numbers or card security codes on its systems when those credentials are collected directly through Stripe.

6.5 Fees

Any charge payable through CrayonHub will be displayed or otherwise communicated as part of your account, invoice, childcare agreement, fee schedule, or payment process.

Your obligation to pay childcare tuition or other charges is governed by the applicable enrollment agreement, tuition agreement, transportation agreement, fee schedule, or other agreement with Crayon Campus in addition to these Terms.

6.6 Declined and Returned Payments

A payment may be declined or returned because of:

• Insufficient funds
• Incorrect payment information
• Card restrictions
• Bank restrictions
• Fraud-prevention measures
• Expired payment methods
• Processor or network errors
• Other reasons outside CrayonHub’s control

A failed payment does not eliminate the underlying balance owed.

Any returned-payment, late-payment, or similar charge will be governed by the applicable Crayon Campus agreement or disclosed fee policy.

6.7 Refunds

Refund eligibility is determined by the applicable childcare, enrollment, payment, or other agreement governing the original charge.

Submitting a payment through CrayonHub does not create an independent right to a refund.

Approved refunds may be returned to the original payment method where appropriate.

Processing times are affected by Stripe, banks, card issuers, and payment networks and may be outside CrayonHub’s control.

6.8 Payment Disputes and Chargebacks

If you believe a charge is incorrect, please contact Crayon Campus promptly so the issue can be investigated.

Initiating a dispute or chargeback does not automatically eliminate amounts legitimately owed under your childcare or other agreement.

Crayon Campus may provide payment, attendance, enrollment, authorization, or other relevant records to Stripe, a financial institution, or a payment network when responding to a payment dispute.

6.9 Third-Party Payment Processing

Payment processing depends on third-party banks, networks, processors, and service providers.

CrayonHub is not responsible for interruptions, delays, declines, or other errors caused solely by those third-party systems.

Nothing in this section limits any rights you may have under applicable consumer, banking, or payment laws.

7. Communications

By providing contact information, you agree that CrayonHub and Crayon Campus may use that information to send communications related to:

• Your account
• Your child’s care
• Attendance
• Transportation
• Billing
• Payments
• Center operations
• Safety
• Closures
• Scheduling
• Administrative notices
• Security
• Changes to CrayonHub

Some operational or account-related messages may be necessary to provide services and may not be optional while an account remains active.

Marketing communications, if any, will be handled separately as required by applicable law.

8. Acceptable Use

You may not use CrayonHub to:

• Violate any applicable law
• Access information without authorization
• Impersonate another person
• Submit knowingly false information
• Harass or threaten another person
• Upload malicious software or code
• Attempt to bypass security controls
• Probe, scan, or test CrayonHub for vulnerabilities without written authorization
• Interfere with CrayonHub’s operation
• Reverse engineer CrayonHub except where applicable law expressly permits it
• Scrape or systematically extract information without authorization
• Use another person’s credentials
• Use information obtained through CrayonHub for an unauthorized purpose

We may restrict or suspend access when reasonably necessary to protect children, users, Crayon Campus, CrayonHub, or the security of the platform.

9. Privacy

Use of CrayonHub is also governed by the CrayonHub Privacy Policy.

The Privacy Policy describes the types of information processed through CrayonHub and how that information is used and disclosed.

10. Ownership and Intellectual Property

CrayonHub, including its software, design, interfaces, graphics, branding, databases, documentation, and underlying technology, is owned by or licensed to Crayon Campus unless otherwise stated.

These Terms give you a limited, nonexclusive, nontransferable right to access CrayonHub for its intended purposes.

They do not transfer ownership of CrayonHub or its intellectual property to you.

You may not copy, distribute, sell, license, publicly display, reverse engineer, or create derivative works from CrayonHub except as expressly authorized by us or permitted by law.

11. User-Provided Content and Information

You retain any rights you may have in information, documents, photographs, or other material you submit to CrayonHub.

You grant Crayon Campus permission to host, store, reproduce, process, transmit, and display that information to the extent reasonably necessary to provide CrayonHub and related childcare services.

You represent that you are authorized to submit the information you provide.

12. Third-Party Services

CrayonHub may use or integrate with third-party services, including Stripe and other technology providers.

Third-party services may be governed by separate terms and privacy policies.

We are not responsible for a third party’s independent services, policies, systems, or actions, except to the extent required by applicable law.

13. Service Availability

We work to keep CrayonHub available and operating properly, but uninterrupted availability cannot be guaranteed.

The platform may occasionally be unavailable because of:

• Maintenance
• Updates
• Internet outages
• Hosting-provider outages
• Third-party service disruptions
• Security incidents
• Equipment failures
• Events outside our reasonable control

Where practical, we may communicate significant planned or unplanned interruptions.

14. Changes to CrayonHub

We may update, modify, add, or discontinue features of CrayonHub.

We may also make changes when necessary for:

• Security
• Legal compliance
• Regulatory requirements
• Operational needs
• Technical improvements
• Third-party service changes

15. Suspension and Termination

We may suspend, limit, or terminate an account when reasonably necessary because of:

• Unauthorized access
• Misuse of CrayonHub
• Violation of these Terms
• Security concerns
• Fraud or suspected fraud
• Termination of the user’s relationship with Crayon Campus
• Changes to employment or authorization status
• Legal or regulatory requirements

Termination of access to CrayonHub does not eliminate payment obligations or other obligations that arose before termination.

16. Disclaimer

CrayonHub is provided as an administrative and childcare-management tool.

To the extent permitted by law, CrayonHub is provided on an “as available” basis. We do not guarantee that the platform will always operate without interruption, delay, or error.

CrayonHub is not an emergency communications service.

Users should call 911 or appropriate emergency services in an emergency and should communicate directly with childcare personnel regarding urgent issues affecting a child’s health or safety.

Nothing in these Terms limits warranties or rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Crayon Campus and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from the use of or inability to use CrayonHub.

This limitation does not apply where liability cannot lawfully be limited, including any rights or remedies that applicable consumer law does not permit us to waive.

18. Indemnification for Misuse

To the extent permitted by applicable law, users agree to be responsible for losses, claims, or expenses resulting from their intentional misuse of CrayonHub, violation of these Terms, unauthorized access to information, or violation of another person’s rights.

This provision does not require a user to indemnify Crayon Campus for Crayon Campus’s own unlawful conduct, negligence, or conduct for which indemnification cannot legally be required.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where another law is required to apply.

Any legal proceeding relating to these Terms may be brought in a court of competent jurisdiction in Massachusetts, subject to any rights the parties have under applicable law.

20. Changes to These Terms

We may update these Terms periodically.

If a change is material, we may provide notice through CrayonHub, email, or another reasonable method.

Continued use of CrayonHub after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

22. Entire Agreement

These Terms govern use of the CrayonHub platform.

Separate agreements — including childcare enrollment agreements, tuition agreements, transportation agreements, employee policies, or other Crayon Campus agreements — may also apply.

If a separate written agreement expressly conflicts with these Terms concerning a matter specifically addressed by that agreement, the more specific agreement will control for that matter.
